General Terms and Conditions of the Harley Street Hospital for Patients
1. Introduction
1.1. These Patient General Terms and Conditions apply to the contractual relationships between Harley Street Hospital (referred to as “the Hospital”) and Private Patients unless otherwise agreed.
2. Definitions
1.1. Hospital: Harley Street Hospital Limited, registered at 19 Harley Street, London, England, W1G 9QJ, with Company Registration Number 11345153, providing CQC-registered facilities for patient care.
1.2 Practitioner: Refers to an independent, registered healthcare professional, including doctors, physiotherapists, specialists, and other practitioners who provide care to patients.
1.3 Private Patients: Includes all patients, whether covered by medical insurance or paying for their own treatment, regardless of their eligibility for NHS care.
1.4 Overseas Patients: Refers to patients who are not ordinarily resident in the UK and are not covered by the NHS.
1.5 Guarantor: An individual (e.g., parent or guardian) who accepts full responsibility for payment of the Hospital’s invoice. The Guarantor remains jointly liable for the full outstanding balance unless settled in full by the patient.
1.6 Applicable Law: All laws, regulations, guidelines, and professional obligations relevant to the provision of care and services, including those governing treatment, procurement, research, and storage of reproductive materials.
1.7 Care: Encompasses consultations, treatment, diagnosis, services (including Sundry Items), and goods provided by the Hospital.
1.8 Contract: Refers to these Terms, the Registration Form, and if applicable, your Treatment Letter.
1.9 Fixed Price: The agreed price for your Treatment Package as outlined in your Treatment Letter.
1.10 Terms: These terms and conditions.
1.11 Treatment Letter: refers to a letter/ invoice/ cost estimates provided by the Hospital outlining the details of your Treatment Package or Care, including procedures and costs.
1.12 Diagnostics: A range of tests and procedures used to diagnose diseases or medical conditions, including blood, urine, and tissue tests, as well as imaging techniques like EOS, fluoroscopy, MRI, CT, and ultrasound scans. Diagnostics are part of the Care provided.
1.13 You/Your: Refers to any patient, visitor, or other individual present at the Hospital.
2. Patient Acknowledgement
2.1 By attending an appointment or checking in, or signing the registration form, you agree to be bound by these Terms. If conflicts arise, these Terms take precedence.
2.2 These Terms are governed by English law, and the courts of England and Wales have non-exclusive jurisdiction.
2.3 The Patient consents to receive medical services and treatment, including diagnostic procedures, surgery, and other care as deemed necessary by the healthcare professionals at the Hospital.
2.4 Practitioners are independent healthcare practitioners and are not employed by HSH. The Hospital is not liable for their actions or omissions. Concerns about practitioner’s care or invoice should be raised with the treating Practitioner first
2.5 Any fees related to practitioners will typically be invoiced directly by the Practitioner. HSH may act as a collection agent on behalf of the Consultant for Treatment Packages.
2.6 The Hospital is not responsible for the theft, loss, or damage to personal belongings.
2.7 Third parties have no rights under these Terms.
2.8 Follow all Hospital safety signs and warnings, and avoid restricted areas.
2.9 Once discharged, the patient is accountable for their own actions, and after surgery, this responsibility transfers to the accompanying person. The Hospital cannot be held responsible or negligent for any incidents outside the Hospital, even if the patient is escorted by hospital staff or representatives.
2.10 Any changes to your circumstances or declarations must be submitted in writing and confirmed by HSH staff.
3. Patient Financial Responsibility
3.1 The fee for Care provided by the Hospital is subject to statutory provisions.
3.2 The Patient agrees to be financially responsible for all costs related to their treatment, including but not limited to consultations, diagnostic tests, medications, surgeries, and hospital stays.
3.3 By attending an appointment or signing the Registration Form, you confirm your right to enter the UK and your ability to pay for your Care.
3.4 Patients transferred to another facility will be financially responsible for all associated costs. If you are not ordinarily resident in the UK, you may be liable for NHS charges if you require treatment that HSH cannot provide or for emergency care.
3.5 The Hospital will provide an estimate of costs upon request, but the final amount may vary depending on the treatment provided.
3.6 HSH may refer you to diagnostic providers under Service Level Agreements (SLA) to expedite tests and access results. You will not be charged more than the provider’s Standard Rates.
3.7 Payment terms: Fees should be paid in advance of the Care. For any unpaid invoice after 30 days, the Hospital may charge interest on overdue accounts at a rate of 2% above the prime lending rate.
3.8 If you fail to pay the required fees, the Hospital may pursue legal action to recover the amount due, including associated costs.
3.9 London Spine Unit Patients: Harley Street Hospital is a Consultant-owned facility with shared financial interests with Mr
Akmal. You have the right to be treated at another facility of your choice
3.10 Insured Patients: If your Care is covered by insurance, it is your responsibility to confirm that your insurer covers the
Care and to provide policy details and authorization.
3.10.1 The Hospital and Doctor are not responsible for verifying your insurance coverage.
3.10.2 You remain responsible for paying any costs not covered or rejected or partially paid by your insurer, including all care related invoices.
3.10.3 If your insurer fails to pay within 30 days, the Hospital may invoice you directly for the outstanding amount.
3.10.4 Insurance policies may not cover all aspects of Care, including treatment for complications or specialist equipment, and you may be responsible for covering those costs.
3.10.5 If you pay for your treatment upfront and seek reimbursement from your insurer, the Hospital’s standard rates will apply unless another rate is agreed upon.
4. Appointments, Cancellations and Late arrivals
4.1 The Patient agrees to attend scheduled appointments or notify the Hospital at least 48 hours in advance if they need to cancel or reschedule.
4.2 The Hospital reserves the right to charge a fee for missed appointments without proper notice.
4.3 Late arrivals may result in reduced consultation time, rescheduling, or cancellation of your appointment.
5. Patient Responsibilities
5.1 The Patient agrees to provide accurate and complete information about their medical history, current condition, and medications. HSH will not acceopt any responsibility due to witheld information such as but not limited to cancellations, complications and referral to another unit.
5.2 The Patient agrees to follow the treatment plan prescribed by the healthcare professionals and to notify the Hospital if they wish to make changes.
5.3 The patient agrees to comply with all health and safety regulations put forward by the hospital
The patient agrees to comply with all financial obligations listed above under section
5.4 The Patient agrees to treat all hospital staff and other patients with respect and courtesy.
6. Patient Rights
6.1 The Patient has the right to receive care that is respectful, dignified, and non-discriminatory.
6.2 The Patient has the right to be informed about their medical condition, treatment options, and possible risks. 6.3 The Patient has the right to refuse treatment
7. Confidentiality and Data Protection
7.1 We are committed to protecting your data in accordance with UK General Data Protection Regulation (UK GDPR) And Data Protection Act 2018
7.2 The Patient’s information will only be shared with medical staff involved in their care, or as required by law and/or medical insurers upon receiving consent from the Patient
7.3 Email and phone communication will be used for account and invoice purposes.
7.4. Access to deceased patients’ health records is governed by the Access to Health Records Act 1990.
8. Scope of Care
8.1 The Hospital agrees to provide medical care in a safe and clean environment.
8.2 The Hospital will ensure that all staff are appropriately qualified and adhere to professional standards.
8.3 The Hospital will inform the Patient of any significant changes to their treatment or condition.
8.4 The Hospital will provide a Treatment Letter and detailed fee information before any Care is administered.
9. Complaints and Disputes
9.1 If the Patient has a complaint regarding their care or treatment, they should contact the Hospital in writing.
9.2 The Hospital will investigate all complaints promptly and provide a response within 28 days
9.3 In the event of a dispute that cannot be resolved through negotiation, the Patient has right to escalate to Independent Sector Complaints Adjudication Service ISCAS before pursuing any legal action.
10. Termination of Treatment
10.1 The Patient has the right to terminate treatment at any time, subject to the payment of any outstanding fees.
10.2 The Hospital reserves the right to terminate the Patient’s treatment if they fail to comply with these terms and conditions or if their behavior endangers staff or other patients.
10.3 The Hospital and Practitioner reserve the right to refuse admission or cancel/change the date of your appointment for any reason, including medical judgment, operational or technical issues, or external events.
11. Assignment
The Hospital and Practitioner may transfer or assign this Agreement to another entity in the event of a business transfer.
12. Force Majeure
The Hospital and Practitioner will not be liable for failure or delay in performance due to circumstances beyond their control.
13. Changes in Applicable Law
Applicable laws may change, preventing the Hospital or Practitioner from providing certain Care. The Hospital will inform you if such changes affect your Care.
14. Jurisdiction and Law
These Terms are governed by English law, and the use of the Hospital’s facilities and services shall be construed in accordance with the laws of England and Wales.
15. Disclaimer
While the Hospital and Practitioner will take reasonable care of your belongings, they are not liable for any loss, damage, or destruction of property, including money and valuables, whether in your possession or given to the Hospital for safekeeping, even if caused by negligence.
Harley Street Hospital operates as a consultant-led facility, with Mr. M. Akmal serving as both a Director at the hospital and the Director of the London Spine Unit, which is also based at Harley Street Hospital.
